Last updated 7 October 2026. Version 2026-10-07-v2.
1. Acceptance of Terms
These Terms of Use (the “Terms”) govern access to and use of this application and its related services (the “Service”). By selecting “Accept”, or by accessing or using the Service, you agree to be bound by these Terms on your own behalf and, where you use the Service on behalf of a business, on behalf of that business. If you do not agree, do not use the Service.
2. Definitions
“Company” means BossHours LLC, a Florida limited liability company, together with its founder, affiliates, licensors, successors and assigns. “Subscriber” means the business that has been given access to the Service. “Authorized User” means an individual to whom a Subscriber or Company has issued sign-in credentials. “Subscriber Data” means the business records a Subscriber or its Authorized Users enter into the Service.
3. License
Subject to these Terms, Company grants Subscriber and its Authorized Users a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service solely for Subscriber’s internal business purposes.
4. Accounts
Authorized Users are responsible for keeping their sign-in credentials confidential and for activity that occurs under their account. Credentials are personal to the individual and may not be shared.
5. Acceptable Use
Except as expressly permitted by these Terms, Subscriber and its Authorized Users will not, and will not permit others to: (a) copy, modify, or create derivative works of the Service; (b) reverse engineer, decompile, or otherwise attempt to derive the source code or underlying structure of the Service; (c) sell, resell, license, rent, lease, or otherwise make the Service available to any third party; (d) access or use the Service to develop or assist in developing a competing product or service; (e) disclose non-public features, screens, or documentation of the Service to any third party, other than content intended for Subscriber’s own customers; or (f) remove or alter any proprietary notice.
6. Intellectual Property
The Service, including all software, source code, databases, designs, interfaces, text, workflows, automations and documentation, together with all modifications, enhancements and derivative works, and all intellectual property rights in any of the foregoing, are and will remain the exclusive property of Company. Except for the limited license expressly granted in Section 3, no right, title or interest in or to the Service is granted or transferred to Subscriber or any Authorized User, whether by implication, estoppel, course of dealing or otherwise. All rights not expressly granted are reserved.
7. Feedback
Subscriber and its Authorized Users may provide suggestions, requests or other feedback regarding the Service. Company may use and incorporate feedback without restriction or obligation, and all right, title and interest in any resulting improvements vests in Company.
8. Subscriber Data
As between the parties, Subscriber retains all right, title and interest in Subscriber Data and in its own business name and marks. Subscriber grants Company a limited license to host, process and display Subscriber Data solely to provide and support the Service. Upon termination, Company will make an export of Subscriber Data available on request within a reasonable period.
9. Confidentiality
Each party will keep confidential the non-public business and technical information of the other that it obtains in connection with the Service, and will use that information only as needed to use or provide the Service. This obligation survives termination.
10. Third-Party Services
The Service may interoperate with third-party services, such as payment processors. Use of those services is governed by their own terms, and Company is not responsible for them.
11. Disclaimer
The Service is provided “as is” and “as available”. To the fullest extent permitted by law, Company disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. The Service does not provide legal, tax, accounting or code-compliance advice.
12. Limitation of Liability
To the fullest extent permitted by law, Company will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising out of or relating to the Service or these Terms.
13. Term and Termination
These Terms remain in effect while Subscriber or its Authorized Users have access to the Service. Either party may end access on written notice. Sections 5 through 9, 11, 12, 15 and 16 survive termination.
14. Changes to These Terms
Company may update these Terms from time to time. When the Terms change, Authorized Users will be asked to review and accept the updated Terms before continuing to use the Service. Each acceptance is recorded with its date and version.
15. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws rules. The state and federal courts located in or serving Brevard County, Florida have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service.
16. General
These Terms, together with any written agreement between Company and Subscriber, are the entire agreement regarding the Service; where such a written agreement conflicts with these Terms on commercial matters, that agreement controls. Nothing in these Terms creates a partnership, joint venture, employment or agency relationship. Subscriber may not assign these Terms without Company’s written consent; Company may assign them to a successor. A breach of Sections 5, 6 or 9 may cause harm for which damages are not an adequate remedy, and Company may seek equitable relief. If any provision is held unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver.
